创设海关法院：现实与可能

为适应加入世贸组织的新形势 ,我国应建立与对外贸易相协调的专门海关法院。借鉴美国海关法院制度的经验 ,创设适应社会主义市场经济体制要求的中国海关法院制度 ,对扩大改革开放、促进国际贸易意义重大。     

Competitive Liberalization,Competitive Imperialism,and Intellectual Property

Aggressive pursuit of free trade agreements (FTAs) and customs unions (CUs) by major and minor trading powers alike challenges the conventional wisdom in favor of such pursuit – competitive liberalization. An equally plausible explanation for an active bilateral and regional trade agreement policy, one which effectively de-emphasizes multilateralism, may be competitive imperialism. The protection and enforcement of intellectual property rights is one area in which new provisions, going beyond multilateral rules, are being negotiated and written into FTAs and CUs. Such provisions may yield insights into which characterization of bilateralism and regionalism – competitive liberalization or competitive imperialism – is more apt. 清末民事习惯调查与《大清民律草案》的编纂

有关资料表明,在清末制定民法典的过程中,虽然立法者极为重视本国民事习惯并进行了大量的调查工作,但在当时的条件下,难以将本国民事习惯采纳为成文法。从宣统三年完成的《大清民律草案》来看,本国民事习惯几乎没有对编纂民律草案产生直接影响。     

论国际惯例在我国民法典中的确立

我国民事立法史上对国际惯例的规定存在诸多不足。国际惯例的特性、功能和效力影响我国民法典的制定。应对国际惯例予以深入思考和科学对待,并在民法典中确立国际惯例的应有地位。     

Risk management for targeting customs controls in developing countries: a risky venture for revenue performance?

Customs authorities in developing countries are often reluctant to forget systematic inspections for fear of risking revenue loss. Such physical inspections however, impede rather than facilitate trade. Control selectivity is therefore a key issue in customs administration reform. This paper shows how a sophisticated risk management method can facilitate trade by automatically and rationally selecting transactions, with the end result of actually enhancing revenue performance. 浙江民艺的保护与活化——以临安“天目窑”为例

‘Region’is the origin of Folk Art’s protection, local entities’ direct involvement and voluntarily protect is needed in the practice of Folk Art’s research and administration. This is the key factor of Folk Art’s inheritance, protection and exploitation. This article takes ‘Temmoku Kiln’ in Linan, Zhejiang as an example, through exploring its firing and using trajectory, propagation and communication, culture and religious connotation to study the countermeasures of ‘Temmoku Kiln’s protection and exploitation, and find the reference path for Folk Art’s development and traditional industry’s exploitation in other regions of Zhejiang Province.     

Brexit: A Cliff Edge or a Small Bump in the Road?

It is becoming increasingly accepted, not least by the Prime Minister and opposition leadership, that the negotiation of a comprehensive trade relationship with the EU is necessary to prevent the UK economy falling off a ‘cliff edge’. This concern is shaping the UK's strategy towards negotiations with the EU and has provided at least part of the motivation for the UK to consider requesting a transition period to facilitate the Brexit process. But how accurate are these fears? What evidence is there for the existence of a ‘cliff edge’? How disastrous would it be for the UK to revert to trading with the EU on the same basis as most other countries in the world, namely according to World Trade Organisation rules? This article seeks to address these issues and it highlights a number of implications for policy makers which flow from understanding the available evidence a little more clearly.     

从闽南方言俗语看闽、台婚姻旧俗——《闽南话漳腔辞典》札记

本文认为,<闽南话漳腔辞典>(中华书局2007年版)是方言志、亦是民俗志著作;"以风俗解释方言,即以方言表现风俗"是方言学、亦是民俗学之道.本文从<闽南话漳腔辞典>收录的闽南方言俗语及其释义部分举例取证,描述或补述闽、台婚姻旧俗之若干情节,说明和证明闽、台两地民俗文化的共同性.

如何保障我国《婚姻法》在少数民族地区的贯彻执行

在我国这样一个统一的多民族国家,各少数民族的婚姻制度和风俗习惯各具特点。这些特点与我们当前的婚姻立法不相适应的情况时有发生。在此情况下,就如何在少数民族地区确保我国婚姻立法的效力而又充分尊重各少数民族的婚姻制度和风俗习惯的问题进行探讨是十分必要的。
